CISPA
, Cyber Intelligence Sharing and Protection Act
I strongly feel some Déjà vu coming on with this article, reason being that it was only a few months ago I was writing about SOPA and the dangers of that bill. Nevertheless, CISPA, or Cyber Intelligence Sharing and Protection Act H.R. 3523 is the worst nightmare of anyone who uses the Internet.
Without overstating the matter, CISPA is the real life version of George Orwell’s “1984″ except in CyberSpace and brought to you by the fine Republicans of the GOP along with some shortsighted Democrats.
Why Should I Fear of CISPA HR 3523
I’m going to tell you what you, if you’re online and reading this article, have to fear from CISPA.
First and foremost CISPA will hand over power to companies and the government to bypass privacy protections, CISPA will also give corporations and Government all types of powers to share information about what YOU, and Americans in general, do online.
Do I have your attention yet? The Internet, as we know it today, will cease to be a bastion of free speech without reprisal. You’ll be thinking twice what you post on FaceBook or any other website. The Internet will be transformed into the worlds largest information gather device.
All the Government would need is some extremely vague sense that the information they require on you, relates to a “cyber threat.” What a “Cyber Threat” is, is a poorly defined concept in the CISPA bill You’ll never know they shared that information. Or even that your information is being collected for whatever reason.
I’ve Done Nothing Wrong, Why Should I Fear CISPA
How would you like everything you do online to be proofread by “Big Brother?” You see, CISPA will hand over your right to privacy and allow the Government to spy on your email traffic, comb through your mobile texts, filter your online content as well as blocking access to popular websites you may wish to read.
It goes beyond Government oversight and is without Judicial overview.
Lets pretend that you’re a musician and you write music, now lets say that you wrote a song, performed and filmed it with your iPhone and posted it to YouTube. You wake up the following day to find that your YouTube video has gone viral but the following day you realize that you’ve been banned from YouTube (for copyright violations) and your Internet service provider has sent you an email that your Internet service may be cut off if you continue to violate copyright.
What copyright did you violate with your original song? Some of the chord progressions in your song happen to sound a little bit like the chord progressions in some long forgotten song over which SONY or Disney or some other corporation holds a copyright to.
Unde CISPA, the burden of proof is on you, it is you who have to prove your are innocent of copyright violation instead of the Corporations who accused your of copyright violations.
Under CISPA, if a Corporation accuses you of Copyright infringement than you are immediately guilty until proven innocent. Since CISPA would remove all judicial overview process out of the equation you don’t even have anyone to appeal to. You have to hire an attorney and sue that corporation and their huge panel of attorneys. Who do you think is going to win that lawsuit? Would you even have the money to attempt such a lawsuit?
“CISPA’s broad language could lead all too easily to governmental and corporate attacks on our right to speak freely online. And while there is a real need to protect vital national interests from cyber attacks, we can’t do it at the expense of our basic civil rights.” ~ Save The Internet
You may think that CISPA has nothing to do with you but you’re wrong. CISPA has everything to do with you!
